3. APPLICATION AND ACCEPTANCE

3.1. These Terms and Conditions apply to all orders placed through the Website.

3.2. By ticking the relevant box at checkout, the Customer confirms that they have read and accept the Terms and Conditions.

3.3. The Terms and Conditions are available on the Website in a form that allows them to be stored and reproduced.

4. GOODS AND PRODUCT INFORMATION

4.1. The Seller provides descriptions, images, composition details, sizes and prices for the Goods.

4.2. Minor differences in the colours shown in images may occur due to the Customer’s screen settings, as may minor variations in handmade or screen-printed items.

4.3. Care information for the Goods is provided on the item’s label and/or on the product page.

4.4. The Goods are available in limited quantities. If a Good is out of stock, the Seller may refuse to fulfil the order, provided that it notifies the Customer and refunds the full amount paid within 14 days.

5. PRICES AND PAYMENT

5.1. All prices are in euros and include VAT.

5.2. Delivery charges are not included in the price of the Goods and are stated separately before the order is finalised.

5.3. The total amount payable is displayed to the Customer before the order is confirmed.

5.4. The following payment methods are accepted: debit or credit card, Apple Pay, bank transfer and cash on delivery. Cash on delivery is available only for deliveries within the territory of the Republic of Bulgaria. The available payment methods are displayed at checkout.

5.5. The Seller does not store payment card details. Payments are processed by licensed payment service providers.

5.6. The Seller may change prices. Any change does not affect orders already confirmed.

6. CONCLUSION OF THE CONTRACT

6.1. The contract is deemed concluded when the Customer finalises the order by clicking the “ORDER AND PAY” button and receives a confirmation email from the Seller.

6.2. Before finalising the order, the Customer may review and amend its contents.

6.3. The Seller may refuse to conclude a contract in the event of an obvious error in the price or description, suspected fraud or the Customer’s failure to fulfil previous obligations, provided that it notifies the Customer and refunds any amounts received.

7. DELIVERY

7.1. Delivery terms, timeframes and costs are set out in the Delivery and Returns of Goods Policy, which forms an integral part of these Terms and Conditions.

7.2. The risk of accidental loss of or damage to the Goods passes to the Customer when the Customer or a third party designated by them takes physical possession of the Goods.

8. RIGHT OF WITHDRAWAL (CONSUMERS ONLY)

8.1. The Consumer has the right to withdraw from the contract without giving any reason within 14 days of the date on which the Consumer or a third party designated by them received the Goods.

8.2. Where an order comprises several Goods delivered separately, the period runs from receipt of the last of the Goods.

8.3. The right of withdrawal is exercised by means of an unequivocal statement to the Seller. The model form in Annex 2 may be used, but this is not mandatory.

The Consumer may also exercise their right of withdrawal online using the “Withdraw from the contract here” function, available at the bottom of every page of the Website throughout the withdrawal period. Once the Consumer confirms the withdrawal, the Seller will send confirmation to the email address provided by the Consumer without undue delay and no later than the end of the business day, setting out the content of the statement and the date and time it was submitted.

8.4. Permitted examination and testing of the Goods

The Consumer is entitled to examine and try the Goods in the manner permitted in a typical retail shop, to establish their nature, characteristics and proper functioning, including by briefly trying them.

8.5. Liability for diminished value

The Consumer is liable only for any diminished value of the Goods resulting from handling other than that necessary to establish their nature, characteristics and functioning.

Circumstances that generally result in diminished value include:

  • wearing the Goods outside the home, including at events, photo shoots or other occasions;
  • visible traces or odours from washing, ironing, cosmetics, perfume, deodorant or cigarette smoke;
  • damage, stains or tears that were not present on delivery;
  • permanent changes to the Goods (such as alterations, shortening or dyeing).

The removal of labels is not grounds for refusing to accept a return and does not in itself give rise to a deduction.

8.6. The full procedure for returns, inspection and deductions is set out in the Delivery and Returns of Goods Policy.

8.7. Exceptions to the right of withdrawal

As at the date of the last update, the Seller does not offer Goods for which the right of withdrawal is excluded.

9. STATUTORY GUARANTEE OF CONFORMITY AND CLAIMS

9.1. The Seller is liable for any lack of conformity of the Goods with the contract that exists at the time of delivery and becomes apparent within two years of delivery, in accordance with the Bulgarian Act on the Provision of Digital Content and Digital Services and on the Sale of Goods.

9.2. Unless proved otherwise, any lack of conformity that becomes apparent within one year of delivery is presumed to have existed at the time of delivery.

9.3. Liability under clause 9.1 does not cover changes to the Goods resulting from normal wear and tear, failure to follow the care instructions on the label or mechanical damage caused after delivery.

9.4. The procedure for submitting claims is set out in the Claims and Refunds Policy.

9.5. A reminder of the statutory guarantee of conformity is provided on the Website by means of the harmonised notice under Article 47(1), point 12 of the Consumer Protection Act.

10. CUSTOMER OBLIGATIONS

10.1. The Customer undertakes to provide accurate and complete delivery details.

10.2. The Seller is not liable for delayed or unsuccessful delivery resulting from inaccurate or incomplete details provided by the Customer.

10.3. The Customer undertakes not to use the Website for unlawful purposes or to take any action that compromises its security or normal operation.

11. PREVENTION OF ABUSE

11.1. The Seller processes data on each Customer’s order and return history to prevent fraud, under the conditions described in the Privacy Policy.

11.2. Where repeated returns of Goods with diminished value or other actions taken for abusive purposes have been established, the Seller may refuse to conclude future contracts with the same person. The Customer is notified in writing of the refusal and the grounds for it and has the right to object.

11.3. A refusal under clause 11.2 does not affect rights already exercised under contracts already concluded.

12. INTELLECTUAL PROPERTY

12.1. The “Lost Bandidos” name and logo, designs, images, texts, graphics and videos on the Website are legally protected and belong to the Seller or are used by it on a valid legal basis.

12.2. Reproduction, distribution and use of the content without the Seller’s prior written consent are prohibited.

13. LIABILITY

13.1. The Seller is liable in accordance with applicable law.

14. FORCE MAJEURE

14.1. The Seller is not liable for non-performance due to force majeure: circumstances beyond its control that could not have been foreseen or prevented.

14.2. If such a circumstance occurs, the Seller notifies the Customer and indicates the expected duration of the delay. If performance becomes impossible, the contract is terminated and the amounts paid are refunded.

15. PERSONAL DATA

15.1. The processing of personal data is governed by the Privacy Policy and Cookie Policy published on the Website.

16. AMENDMENTS TO THE TERMS AND CONDITIONS

16.1. The Seller may amend these Terms and Conditions.

16.2. Amendments are published on the Website. Customers with registered accounts are sent notice of adopted amendments to the email address they have provided at least one month before the amendments take effect, and the Customer has the right to terminate the contract without penalty within that period.

16.3. Each order is subject to the version of the Terms and Conditions in force at the time the order is finalised.

17. DISPUTE RESOLUTION

17.1. The Seller and the Customer endeavour to resolve disputes through negotiation.

17.2. The Consumer has the right to refer a dispute to a conciliation commission attached to the Commission for Consumer Protection (CPC). No sector-specific conciliation commission has been established for disputes under contracts for the sale of Goods. The competent body is the General Conciliation Commission based in Varna, whose territorial remit covers the regions of Varna, Dobrich and Silistra. Information on the conciliation commissions and the procedure for referring disputes to them is available at www.kzp.bg/bg/pomiritelna-komisiya.

17.3. The Consumer has the right to lodge a complaint with the Commission for Consumer Protection (CPC).

17.4. If no agreement is reached, the dispute is referred to the competent Bulgarian court. A Consumer from the EU retains the right to bring proceedings before the court of their place of residence in accordance with the applicable rules of private international law.

18. APPLICABLE LAW

18.1. Matters not covered by these Terms and Conditions are governed by the law of the Republic of Bulgaria.

18.2. If the Consumer is habitually resident in another Member State of the European Union, they also benefit from the mandatory consumer protection provisions of that state, to the extent provided for by applicable law.

Annex 1

Standard instructions for Consumers on exercising the right of withdrawal

Right to withdraw from the contract.

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the date on which you or a third party designated by you, other than the carrier, received the Goods. Where an order comprises several Goods delivered separately, the period runs from receipt of the last of the Goods.

To exercise your right of withdrawal, you must inform us by an unequivocal statement (for example, by letter sent by post or email) addressed to: MIYAMMI-29 EOOD, 14 Kesten Street, Entrance V, Floor 2, Apartment 4, 9000 Varna, email: hola@lostbandidos.com.

You may use the form in Annex 2, but this is not mandatory.

You may also exercise your right of withdrawal from the contract online using the “Withdraw from the contract here” function, available at the bottom of every page of www.lostbandidos.com. If you use this online function, we will send you an acknowledgement of receipt of your withdrawal on a durable medium (for example, by email) without undue delay, including its content and the date and time of its submission.

To meet the withdrawal deadline, it is sufficient to send your communication before the 14-day period expires.

Effects of withdrawal.

If you withdraw from the contract, we will reimburse all payments received from you, including delivery costs (except for any additional costs arising from your choice of a delivery method other than the least expensive standard delivery method offered by us), without undue delay and in any event no later than 14 days from the date on which we were informed of your decision.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed to another method. In any event, you will not incur any costs as a result of the reimbursement.

We may withhold reimbursement until we have received the Goods back or you have supplied evidence that you have sent the Goods back, whichever occurs first.

We expect you to return the Goods without undue delay and in any event no later than 14 days after the date on which you notified us of your withdrawal from this contract. Goods must be sent via Econt to its “Sofia Cherkovna” office at 10–12 Maragidik Street, Sofia, with MIYAMMI-29 EOOD as the recipient. Goods sent via another courier or by post must be returned to: 79D Sitnyakovo Boulevard, Floor 2, Apartment 39, 1111 Sofia. The deadline is met if you dispatch the Goods before the 14-day period expires.

You must bear the direct costs of returning the Goods. The estimated cost of returns from Bulgaria is between EUR 3.49 and EUR 5.14; for returns from another country, the cost depends on the rates charged by your chosen courier.

You are liable only for any diminished value of the Goods resulting from trying them other than as necessary to establish their nature, characteristics and functioning.
